Terms & Conditions of Sale

Article 1 — Overview

Babysit-Tropez connects private individuals (hereinafter “the Client”) with independent babysitters (hereinafter “the Babysitter”). Babysit-Tropez is not a childcare provider or an employer. Its role is limited to connecting the two parties.


Article 2 — Purpose

These Terms & Conditions define the conditions under which Babysit-Tropez provides its matchmaking service, from initial contact to mission confirmation.

Any matchmaking request implies full and unconditional acceptance of these Terms & Conditions.


Article 3 — Service Process

3.1 — Request
The Client submits their childcare request (date, times, location, number and age of children) via the website or by WhatsApp.

3.2 — Babysitter Search
Babysit-Tropez searches for an available babysitter matching the mission criteria. No payment is requested before confirmation of a babysitter’s availability.

3.3 — Confirmation and Payment
Once an available babysitter has been identified, the Client receives a payment link to pay the booking fee. The mission is confirmed upon receipt of payment.


Article 4 — Booking Fees

The booking fee represents 20% of the babysitter’s remuneration, with a minimum of €20. It exclusively covers the matchmaking service provided by Babysit-Tropez.

This fee is separate from and independent of the babysitter’s remuneration, which is paid directly by the Client to the babysitter on the day of the assignment.

The booking fee is paid by credit card (via a secure Stripe payment link) or by bank transfer.

Article 4 bis — Pricing and VAT

Booking fees are stated in euros, all charges included. Babysit-Tropez benefits from the VAT exemption threshold in accordance with Article 293 B of the French Tax Code. VAT is therefore not applicable.


Article 5 — Cancellation and Refund

5.1 — Cancellation by the Client

Any cancellation request must be submitted in writing via WhatsApp message. The date and time of receipt of the message shall be taken as proof.

5.2 — Cancellation by the Babysitter
In the event of cancellation by the babysitter, Babysit-Tropez undertakes to find an available replacement as soon as possible. If no replacement babysitter can be found, the booking fee will be fully refunded to the Client, with no charges or penalties.

5.3 — No Available Babysitter
If no babysitter is available to meet the Client’s request, no booking fee will be charged.


Article 6 — Liability

6.1 — Matchmaking Role
Babysit-Tropez acts exclusively as an intermediary. The babysitters listed are independent contractors with whom Babysit-Tropez has no employment relationship.

6.2 — Limitation of Liability
Babysit-Tropez cannot be held liable for:

  • The behaviour, actions or failures of the babysitter during the assignment
  • Any damage, accident or harm occurring during or following a childcare session
  • Any incompatibility between the Client and the matched babysitter. It is the Client’s responsibility to ensure that the proposed babysitter meets their expectations and to carry out any additional checks they deem necessary before the assignment.

6.3 — Profile Verification
Babysit-Tropez undertakes to list only babysitters whose profiles have been verified. However, this verification cannot constitute an absolute guarantee as to the babysitter’s conduct during the assignment.


Article 7 — Personal Data

Personal data collected (name, phone number, email) is used solely for the purpose of processing the matchmaking request. It is not shared with third parties for commercial purposes.

Article 8 — Applicable Law and Disputes

These Terms & Conditions are governed by French law. In the event of a dispute, an amicable resolution will be sought as a priority. Failing that, the competent courts of the Draguignan jurisdiction shall have exclusive jurisdiction.

Article 9 — Client Obligations

The Client undertakes to provide Babysit-Tropez, before the assignment, with all relevant information concerning the children: allergies, special dietary requirements, ongoing medical treatments, disabilities or behavioural disorders, as well as any specific safety instructions.

In the event of an omission or inaccurate information provided by the Client, Babysit-Tropez and the babysitter cannot be held liable for any consequences arising therefrom.


Article 10 — Force Majeure

Babysit-Tropez cannot be held liable for the non-performance of its obligations in the event of force majeure within the meaning of Article 1218 of the French Civil Code (natural disaster, epidemic, strike, widespread outage, etc.). In such cases, the booking fee will be fully refunded to the Client.


Article 11 — Mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, Babysit-Tropez offers a consumer mediation scheme. In the event of an unresolved dispute, the Client may refer the matter free of charge to the following mediator:

Mediation is free of charge for the Client and can be initiated online directly on the mediator’s website.


Article 12 — Amendments to the Terms & Conditions

Babysit-Tropez reserves the right to modify these Terms & Conditions at any time. The new conditions apply to missions requested after they are published online. The current version is
available at any time on the babysit-tropez.fr website.
